GENERAL CONDITIONS FOR PROCESSING PERSONAL DATA

We are aware that the protection of personal data is a fundamental right of every individual to whom personal data relates. By submitting personal data, the website user confirms that they are familiar with the general terms and conditions of the website and the processing of personal data, that the personal data provided is true and accurate, and allows Forapet, trgovina za male životinja in proizvodnja, doo, Mladinska ulica 15, 2204 Miklavž na Dravskem polju, registration number: 9735399000, tax number: 90367324 (hereinafter: the controller), as the controller of personal data, to process it for the purposes for which it was collected.

The user can regularly monitor any changes to the general terms and conditions of business and the processing of personal data here.

As a controller of personal data, we undertake to process it in accordance with the applicable Personal Data Protection Act and the General Data Protection Regulation (GDPR, hereinafter: the Regulation).

In accordance with the Regulation, the personal data controller has also appointed a person authorized to protect personal data, whom you can contact by writing to info@forapet.si or to Forapet doo, Mladinska ulica 15, 2204 Miklavž na Dravskem polje.

Processing of personal data

The controller processes the following personal data and for the following purposes:

• Forapet online store, www.forapet.si: The controller collects the following data: name and surname, e-mail address, contact telephone number, primary address and delivery addresses, time and date of registration and archive of communication related to online purchases, and other data entered by the user when registering on the website. The controller processes the collected personal data on the basis of a contract, namely for the purposes of fulfilling the purchase or order (including sending offers, invoices and other information related to the order and requests for evaluation of purchased products) and other necessary communication with the user. In the event that the provision of personal data is necessary for the conclusion and performance of the contract, you must provide personal data; if you do not provide personal data, the controller will not be able to fulfill the order, as it does not have the necessary data for this. The controller of personal data also uses the collected personal data on the basis of consent to study the user's purchasing habits and for the purpose of direct and targeted marketing. The user may at any time request in writing that the controller permanently or temporarily ceases to use personal data for this purpose.

• Subscription to e-newsletter: the user can subscribe to e-newsletters, with which the controller informs him/her, based on his/her consent until cancellation, about new products in the online store and at other points of sale, about marketing activities and other promotions. By subscribing to e-newsletters, the controller collects the following personal data: name, surname, e-mail address, IP, data about animals that interest the user; in the event that the user registers as a registered user, also the address and telephone number. After sending the form with the e-mail address, the user receives a confirmation message to the specified address. After confirming the message, the user is subscribed to the e-newsletter until cancellation. The user can unsubscribe at any time by clicking on the "UNSUBSCRIBE" button in the sent e-mail message or by sending a request to info@forapet.si and requesting that the controller permanently stop using his/her personal data for this purpose.
• Cookies: The controller processes certain personal data using cookies.

• Registration: As part of the registration, the controller processes the following personal data that the user enters into the registration form: name, surname, email address, telephone number, postal address, information about the animals that interest the user, preferred method of notification, login password and information about purchases made. The controller uses the entered user data to process the user's order. Registration makes it easier for the user to monitor past purchases and shortens the purchase process.

• Management of the Forapet Family: personal data (name, surname, postal address, telephone number and email address) are processed to carry out activities necessary to provide the benefits offered by membership in the Forapet Family: identifying an individual member, summing up the total number of purchases to assign a class for bonus calculation and bonus use, resolving any complaints, the possibility of subsequent bonus additions, logging into the member's account online, for annual notification of members about the status of bonuses and their imminent expiration, and other notifications related to the family's business and operations. Membership in the family is not possible without consent to this processing. Data obtained for this purpose is stored for the duration of the processing and for a maximum of five (5) years after the withdrawal of consent to data processing for this purpose.

Based on the user's consent, the controller processes their personal data as part of registration for the following purposes:

• user experience analysis for the purpose of improving services (to analyze purchases and purchasing habits in order to provide better services and offers, to assist in business operations and for user profiling and automated decision-making to provide a better online user experience and send personalized offers) and
• marketing analyses that will enable the preparation of appropriate offers and improvements to the sales process (for direct marketing purposes: advertising, segmentation and profiling for the purpose of personalized advertising, surveys and for remarketing (targeted advertising) via web browsers and social networks).

As part of the registration or user account, the user can also upload a photo of their pet. By uploading the photo, they also consent to the processing of this personal data for the purpose of publishing the photo when rating and commenting on the product, if the user rates and comments on the product. The user can register even if they do not upload a photo.

A registered user can also provide a product rating. The registered user's first name (without surname) is used to submit a rating, and the user, along with a product rating (from 1 to 5 stars, with 1 being the lowest and 5 being the highest possible rating) and information about whether they would recommend the product to a friend (without this, a product rating cannot be submitted), also provides a descriptive opinion about the product, enters the pet's name, and uploads a photo of the pet with the product. By submitting a rating and providing the data, the registered user consents to the publication of the rating, descriptive comment, and photo of the pet when displaying the comment next to the rated and commented product, and to the processing of personal data for this purpose.

In case the user wishes to delete the user account, the e-mail sent to info@forapet.si must contain the following information: the user's first and last name, address and e-mail address with which the user registered. The message must be sent from the e-mail address with which the user is logged in as a registered member. The user should write that he/she requests the deletion of the user account.

User rights

The user has the rights presented below in relation to their personal data. The user exercises their rights by sending an email to the controller at info@forapet.si .

The controller shall ensure the exercise of the user's rights immediately or within one month of receiving the request. In the event of complexity and a large number of requests, the controller may extend the deadline for exercising the user's rights for a maximum of two (2) additional months and shall notify the user thereof, together with the reasons for the delay, within one month of receiving the request.

If there is doubt regarding the identity of a user submitting a request regarding any of the rights, the controller may request the provision of additional information necessary to confirm the user's identity.

Where the user's requests are manifestly unfounded or excessive, in particular because they are repetitive, the controller may charge a reasonable fee, taking into account the costs of providing the information or communication or implementing the requested action, or refuse to act on the request.

Right to access personal data

The user has the right to obtain confirmation from the controller as to whether personal data concerning him or her are being processed, and, where this is the case, access to personal data and information as specified in the Regulation.

Right to rectification of personal data

The user has the right to request the correction or completion of inaccurate or incomplete personal data at any time, in accordance with Article 16 of the Regulation.

The user can send a request for data change to the e-mail address info@forapet.si or by mail to the address Forapet doo, Mladinska ulica 15, 2204 Miklavž na Dravskem polje.

The change in club member information will be made within fifteen (15) days of submitting the change of information form.

Right to erasure of personal data

The user may at any time submit a request for the deletion of their personal data. The controller shall delete the personal data taking into account the individual request and Article 17 of the Regulation.

Right to restriction of processing of personal data

The user may at any time submit a request to the controller to restrict processing. The controller is obliged to comply with the provisions of Article 18 of the Regulation.

Right to personal data portability

The user has the right to receive personal data concerning him or her, which he or she has held from the controller, in a structured, commonly used and machine-readable format, and the right to transmit those data to another controller without hindrance from the controller to whom the personal data have been provided. The controller shall comply with the provisions of Article 20 of the Regulation.

Right to object

The user has the right, on grounds relating to his or her particular situation, to object at any time to the processing of his or her personal data based on legitimate interests or for direct marketing purposes, including profiling, all in accordance with the provisions of Article 21 of the Regulation.

Right to withdraw consent

The user also has the right to withdraw consent for the processing of personal data in the manner specified above. The withdrawal will not affect the lawfulness of data processing carried out on the basis of consent until its withdrawal.

Ensuring data security

The data provided by the user via forms on the website or otherwise (via e-mail, telephone, etc.) are confidential and are treated in accordance with applicable legislation. The controller carefully protects personal data and prevents their misuse. The controller has defined the method of protecting personal data in internal documents.

If the user believes that there has been a violation of personal data protection, he or she may report this or file a complaint with the supervisory authority (Information Commissioner of the Republic of Slovenia, gp.ip@ip.rs.si ).

Users of personal data

The controller does not disclose personal data to unauthorized third parties. Access to personal data is only granted to persons authorized by the controller (e.g. employees) or contractual partners with whom the controller has concluded appropriate contracts for the processing of personal data.

Data can be transmitted:

• to data processing and information service providers who ensure the smooth operation of the online store and its improvements (hosting on the server, improving the user experience, navigation, e-mail marketing, etc.);
• marketing agencies for remarketing purposes;
• to contractors who ensure a smooth purchasing process (delivery services, etc.), but only to the extent necessary for the successful execution of the order;
• to authorized institutions, if required by law (court, inspectorate, etc.).

Personal data is stored and processed in the Republic of Slovenia and is not exported to countries outside the EU or EEA.

Retention period

The controller stores the data until:

• cancellation, deregistration or deletion requests in accordance with the applicable Personal Data Protection Act and the Regulation;
• fulfillment of the contractual obligation and the expiration of the limitation period, or
• achievement of the purpose for which the data was collected or processed.
